By accessing or using the Beachday™ mobile application (hereinafter referred to as "the App") and any related merchandise purchasing services, you expressly acknowledge and agree to be bound by the terms and conditions set forth in this comprehensive Privacy Policy. This legally binding document outlines the various ways in which Beachday™, its subsidiaries, affiliates, and authorized service providers collect, utilize, maintain, protect, and disclose information obtained from users of our mobile application and merchandise services. It is imperative that you carefully review this Privacy Policy to fully understand our practices regarding your personal information and how we will treat it.

In the course of providing our services, Beachday™ necessarily collects various categories of personal information from users, including but not limited to, personal identifiers such as name, email address, postal address, telephone number, device identifiers, IP addresses, and other similar identifying information. Additionally, we collect and store user-generated content, including photographs, videos, beach reviews, ratings, comments, and any other content that users choose to submit through the App. Furthermore, we automatically collect certain technical information about users' devices, including but not limited to, the type of mobile device utilized, the mobile device's unique device ID, the IP address of the mobile device, the mobile operating system, the type of mobile Internet browsers in use, and various other technical data points that facilitate the proper functioning of our services.

The information collected by Beachday™ is utilized for multiple purposes integral to the operation and improvement of our services. This includes, but is not limited to, facilitating user account creation and maintenance, processing financial transactions related to our shell reward system and merchandise purchases, enabling social networking features, conducting contests and promotional activities, providing location-based services, generating analytics and performance metrics, improving user experience, and maintaining the security and integrity of our platform. Users expressly acknowledge that their information may be used for these purposes and other reasonably related purposes that may arise in the course of business operations.

Regarding the storage and security of user information, Beachday™ implements various physical, electronic, and managerial procedures to safeguard and secure the information we collect. However, users expressly acknowledge that no method of transmission over the Internet, or method of electronic storage, is completely secure, and while we strive to use commercially acceptable means to protect users' personal information, we cannot guarantee its absolute security. Users' shell transaction information is stored securely in our database systems with appropriate encryption and security measures in place.

With respect to music and audio content utilized within the App, users hereby acknowledge and agree that they bear sole responsibility for ensuring proper licensing and permissions for any music or audio content incorporated into their uploads, posts, or any other user-generated content. Beachday™ expressly disclaims any responsibility or liability for users' use of copyrighted music or audio content, and users hereby agree to indemnify and hold harmless Beachday™, its officers, directors, employees, agents, and affiliates from any claims, damages, or expenses arising from their unauthorized use of copyrighted music or audio content. Users further acknowledge that Beachday™ reserves the right to remove any content that may infringe upon intellectual property rights without prior notice.

Information sharing and disclosure may occur under certain circumstances, including but not limited to sharing with third-party service providers who assist in operating our business, such as payment processors, data analytics providers, cloud storage providers, customer service operators, and other service providers who require access to such information to perform their functions. Users expressly acknowledge that their information may be disclosed when required by law, such as to comply with a subpoena, bankruptcy proceedings, or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect users' safety or the safety of others, investigate fraud, or respond to a government request.

Regarding international data transfers and processing, users acknowledge that their information may be transferred to and maintained on computers located outside of their state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in their jurisdiction. If users are located outside the United States and choose to provide information to us, they acknowledge and agree that we transfer and process their information in the United States and any other country where we operate. Furthermore, all financial transactions, regardless of origin, are processed in the United States, and users expressly consent to this practice.

The shell reward system, which is integral to the App's functionality, operates through our secure database systems. Users acknowledge that all shell-related transactions are recorded and maintained in our systems with appropriate security measures. Users further acknowledge that the value of shells may fluctuate and that Beachday™ makes no guarantees regarding the future value or redeemability of shells. The conversion rate of shells to traditional currency may vary, and users accept all risks associated with participating in the shell reward system.

Beachday™ reserves the right to modify this Privacy Policy at any time, and such modifications shall be effective immediately upon posting of the modified Privacy Policy. Users' continued use of the App following any such modifications constitutes their acceptance of the modified Privacy Policy. It is users' responsibility to regularly review this Privacy Policy to stay informed of updates, as continued use of the App will be deemed acceptance of any modified terms.

This Privacy Policy shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Users agree that any dispute arising from or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts located within the United States. If any provision of this Privacy Policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Users acknowledge that this Privacy Policy, together with our Terms of Service, represents the complete agreement between users and Beachday™ regarding the subject matter hereof and supersedes any prior agreements or understandings, whether written or oral.

 

User Data Deletion Rights

Beachday™ respects users’ rights to access, modify, and delete their personal data.

Users may request the deletion of their account and associated personal data at any time by submitting a request through one of the following methods:

• Email: Send a request to info@beachday.com with the subject line “Data Deletion Request”
• In-App (if available): Users may request deletion directly through account settings

Upon receiving a verifiable request, Beachday™ will:

• Delete the user’s account and associated personal data from our systems
• Remove or anonymize user-generated content where feasible
• Retain only information required for legal, security, or legitimate business purposes (such as fraud prevention, financial records, or compliance obligations)

We will process data deletion requests within a reasonable timeframe, typically within 30 days, unless a longer period is required by law.
